I wonder if anyone can give me advice on how to get my ex-wife to carry
out the agreement to sell our home and split equity 50/50.
We both went to mediation during divorce and I agreed to accept a fixed
sum provided it was paid within 6 months - I then walk away and my ex
keeps the house.
However, my ex did not come up with the cash so it meant she then had
to put the house up for sale and split any equity 50/50, as clause
states in mediation, if she couldn't pay me the cash sum agreed.
My ex then claimed this clause was not clearly explained to her by her
attorney so we went to court and the judge ruled that the agreement
stood and that the "attorneys should go away and sort this out" -
whatever that means??
It's been another 6 months now, the house isn't up for sale and my ex
says she won't put it up for sale.
My attorney has written to her attorney several times and we still get
nowhere.
My ex says she will agree to put house up for sale and then weeks later
she still hasn't done so and we get back to square one.
My attorney keeps telling me he's waiting for her attorney to get in
touch.
Does anyone have any advice on how I should proceed and what I need to
ask my attorney to do because he just seems to be sitting on his hands
taking money from me every month?
